We may revise these Terms at any time; continuing to use our site or services after changes means you accept the updated Terms. By starting a project with us or downloading any free content (e.g. lead magnets), you automatically agree to these Terms.
1. Scope of Services
thegoldcode.de offers custom digital services worldwide in web design (Framer, WordPress), branding, and marketing consulting. Deliverables may include websites and creative assets in formats like PDF, JPG, or PNG. All services are tailored individually and carried out on a project basis as agreed in writing.
2. Booking & Payment
We quote projects at a fixed rate. For large projects (typically €3,000 or more), a 50% non-refundable deposit is required to secure the booking. The remaining 50% is due upon approval of the final draft and before delivery. Smaller projects may have different payment terms as agreed.
All payments must be made in full and on time via the agreed method (e.g. bank transfer, PayPal, Stripe). Once project work has begun, all payments are non-refundable.
- Late Payments: Work may be paused or delayed if invoices are not settled on time.
- No Refunds: Payments and deposits are non-refundable once work has started, regardless of project cancellation or changes.
3. Delivery of Work
Digital deliverables are provided via email, file sharing, or direct publishing to agreed platforms. Final files (e.g. websites, PDFs, images) are delivered upon full payment. Post-delivery revisions or technical support are not included unless otherwise agreed and may incur additional costs.
4. Intellectual Property & Usage Rights
All creative materials (designs, layouts, texts, code, visuals) remain the intellectual property of thegoldcode.de unless otherwise agreed in writing. Upon full payment, clients receive a non-exclusive, perpetual, worldwide right to use the final deliverables for their intended business use.
This usage right does not include resale or transfer to third parties. Copyright remains with the creator unless exclusive rights are contractually transferred for an additional fee.
- Non-confidential project work may be reused or shown in thegoldcode’s portfolio or marketing.
- Exclusive usage or full transfer of rights must be agreed separately.
5. Limitation of Liability
All services are provided “as is.” We cannot guarantee specific outcomes (e.g. business results, rankings, client leads). thegoldcode is not liable for indirect, incidental, or consequential damages such as lost profits, downtime, or reputational damage.
Our maximum liability is limited to the total fees paid for the specific project. No further compensation shall be claimed beyond this amount.
6. Data Privacy
We handle your personal data in compliance with GDPR. For details, please see our Privacy Policy. When you submit your information via our forms or download free materials (e.g. lead magnets), we may store your email and name in our CRM system (Brevo) to send occasional updates. You may unsubscribe at any time.
7. Governing Law
These Terms are governed by the laws of the Federal Republic of Germany. Legal disputes will be handled in the appropriate court of jurisdiction in Germany, unless otherwise agreed or required by consumer protection laws in your country of residence.
8. Changes to Terms
We may update these Terms at any time without prior notice. The latest version is always available on this page. Continuing to use our website or services implies acceptance of the current version.
